משפחות ותיקות מכפר שלם עלולות להיזרק לרחוב ב- 15 ביולי!

במוצאי שבת הקרובה, ה-7 ביולי בשעה 21:00.

רקע:

צווי הפינוי כנגד תושבי המתחם ברחובות מח"ל-משה דיין מבטאים את ההתנערות של המדינה מאחריות כלפי אזרחיה. משפחות שחיו במקום כבר שניים ושלושה דורות, מאז 1948-49, מקבלות כרעם ביום בהיר צווי פינוי. עשרות שנים הם שלמו שכר דירה ל-עמידר המתכחשת וטוענת: "הכסף נגבה בטעות"! הסיפור האמיתי הוא לא דמי השכירות אלא עסקאות נדל"ן מאחורי הגב של התושבים. הקרקעות הגיעו לידיה של משקיעה פרטית שקנתה בזול שטח מאוכלס ובמקום לדון על פינוי תמורת פיצוי - היא מנשלת! לצערנו, בתי המשפט כבר לא מתייחסים לזכויות של התושבים הנובעות מעצם ישיבתם בקרקע ומגוריהם במשך עשרות שנים. אין עוד בתים, תושבים וזכויות חזקה אלא נדל"ן, "פולשים" וזכויות קניין. כדי שגברת ספסרית שלא חיה במקום תממש את זכויות הקניין שלה - הוצאו צווי פינוי לתושבים!

בעידן ההפרטה המדינה מתכחשת לאחריות וספסרי הקרקעות מנשלים את התושבים!

זה עלול לקרות לתושבי מח"ל-משה דיין כבר ב- 15 בחודש וזה עלול לקרות אחר כך גם לתושבים נוספים בכפר שלם. חברת חלמיש האחראית על פינוי רוב שטחי הכפר מעדיפה להגיש תביעות במקום לדון עם התושבים על פינוי אמיתי. באמצע שנות ה- 90 פונו משפחות רבות בתנאים הוגנים. התושבים הותיקים שנותרו מבקשים לבצע את הפינוי שלהם בפיצוי הולם ותנאים הוגנים.

כמו במקומות אחרים, על אפליה והזנחה ארוכות שנים מצד הרשויות נוספו עכשיו בכפר שלם ניסיונות נישול מצד משקיעים פרטיים בשעה שחברות השיכון עמידר וחלמיש המתכחשות לחובתן הציבורית, קודם כל לתושבים.

זהו מאבק מקומי צודק ובו בזמן זהו גם מאבק על זכויות חברתיות רחבות, כנגד הפיכת זכויות הקניין לעקרון עליון. זהו גם חלק מהמאבק על זכויות הקהילות המקומיות להשתתף בקבלת החלטות לגבי הפיתוח של שכונותיהם, על זכותן להטיל וטו בפני קבלנים ובפני חברות ציבוריות.

די להכפשת התושבים! די לתביעות המשפטיות! די לפינויים החד צדדיים!

The state is abdicating its responsibility to its citizens

Long term residents of Kfar Shalem are under threat of being thrown out to the street on July 15th.

Background:

The eviction orders against the residents of the compound at 'Mahal' and Moshe Dayan streets represent the abdication of the state of its responsibility to its citizens. Families who have lived at the compound for two or three generations since 1948-49 have suddenly received eviction orders. For decades they have been paying rent to Amidar which now claims that "the money was collected by mistake!"

The real story is not rent but real estate deals struck behind the backs of the residents. The lands have fallen into the hands of a private investor which bought settled land for little money and instead of discussing compensation for resident is dispossessing them! Unfortunately, the court does not recognize the rights of the residents stemming from their living on the land for decades. There is no discussion of houses, residents or rights of possession only of "squatters" real estate and property rights. The eviction orders were issued in order that 'Ms speculator' who does not live in the area will be able to realize her property rights!

In the era of privatization the state abdicates its responsibility and the land speculators dispossess residents. This might happen to the residents of the 'Mahal'- Moshe Dayan compound on the 15^th and it might happen to other residents of Kfar Shalem later. The 'Halamish' company which is responsible for resettling residents from most of the lands of the village prefers to file law suits instead of negotiating true resettlement. In the middle of the 90's many families were resettled with fair conditions/ The long term residents who remain ask that their resettlement will be with fair conditions and adequate compensation.

Like in other places, in addition to years of neglect and discrimination by the authorities the residents now face attempts to dispossess them by private investors while Amidar and Halamish abdicate their responsibility to public housing. For the residents this is, first of all, a local struggle for justice and at the same time this is also a part of a wide struggle. A struggle for many social rights and against turning property rights into a supreme value. This is also a part of the struggle for local communities to take part in making decisions about the development of their neighborhoods and for their rights to veto the plans of developers and public companies.

Stop the slandering of residents! Stop the law suits!
Stop unilateral evictions!
Resettlement only by agreement and with full compensation !
